Labour Market Impact Assessment

Labour Market Impact Assessment is an assessment which results into a Positive or a negative outcome. A positive Labour Market Impact Assessment is required by a Canadian Employer in order to hire a foreign worker. An LMIA signifies a need for a temporary foreign worker and that no Canadians or Canadian Permanent residents are available to perform the job.

LMIA Process:

The Assessment process is undertaken by Employment and Social Development Canada (ESDC). There are multiple programs with specific requirements through which an Employer may hire a Temporary Foreign worker and the process of LMIA depends on the program. The programs are:

  • high-wage workers
  • low-wage workers
  • workers through the Seasonal Agricultural Worker Program
  • workers through the Agricultural Stream

All Canadian Employers must conduct recruitment efforts in order to hire Canadians and Permanent residents and if they fail to find someone suitable and wish to hire a foreign worker they may apply for an LMIA. While applying for an LMIA to hire a foreign worker the Employer must demonstrate their business and the job offer to be legitimate.
